TEXAS WATER PARK INJURIES DURING SUMMER

Water-park-injuries-1.jpg

Texas water park injuries can occur when safety is an issue at the theme park. During summertime, as parks fill up with crowds of visitors, many people may not realize that certain risks are involved.

Such was the case in 2016 when a new ride opened up at Schiltterbahn's park in Kansas City. The family-owned business Schlitterbahn operates four water parks in Texas and one in Kansas City. A week after the Kansas City Park opened, while on the highest waterslide in the world, called "Verruckt," a 10-year old boy named Caleb Schwab died. The accident resulted in the boy's decapitation, and the two women riding with him suffered serious facial injuries.

Verruckt contained multi-person rafts that dropped from 17-stories high and reached speeds of 70 mph and ended with a 50-foot drop into a water pool. Since the fatal accident occurred, the ride has remained closed, and the park is awaiting legal consent prior to tearing it down.

Fox News published an article about the tragedy.

LAWSUIT AND SETTLEMENT

Caleb's family sued, holding various parties accountable for the dangerous ride. Caleb's father is a Republican Kansas state representative, named Scott Schwab, and the family wanted to prevent any other child from ever experiencing such a tragedy.

A $14 million settlement was reached with SW1 and KC Water Park, two companies associated with Schlitterbahn. The remaining money (totaling a $20 million settlement) came from a settlement with the general contractor, raft manufacturer and a consultant company in the building of the 17-story water slide.

CONCERNS NATIONWIDE ABOUT WATER PARK INJURIES

Kansas subsequently passed legislation that imposed greater restrictions on theme park rides, and previously it had been known as a state among five others that had the lightest restrictions in the country.

In another article, Fox News interviewed an amusement park safety consultant who said that while theme park accidents seldom occur, when they do happen, they are horrible tragedies generally resulting from human error. No federal regulations or oversight exists for investigating theme park rides. Oversight occurs at the state and local levels.
